Terms and Conditions

Faunaesthetic Events Ltd.

1. Introduction and acceptance

These Terms and Conditions (the "Terms") govern your use of the event website
and ticketing service at https://faunaesthetic.ca (the "Site") operated by
Faunaesthetic Events Ltd. ("Faunaesthetic," "we," "us," or "our"), a company
located in Hamilton, Ontario, Canada.

By using the Site (including creating an account, buying a ticket, or attending
one of our events) you agree to these Terms. If you do not agree, please do not
use the Site for those purposes.

These Terms work together with our Privacy Policy, our
Refund Policy, and our Code of Conduct, each of
which is incorporated into these Terms by reference. Where a separate signed
contract applies to you (for example, a vendor or performer agreement), that
contract governs that relationship in addition to these Terms.

We may update these Terms from time to time; see
Section 14 for how changes take effect.


2. Eligibility and age

Our service is for adults. You must be at least 18 years old to create an
account, buy tickets, or attend our events.

Individual events may set a higher minimum age. For example, 19+ where
alcohol is served
, in accordance with Ontario law. The minimum age for each
event is shown on that event's page, and you may be asked for valid
government-issued photo ID at the door. Anyone under the applicable minimum age
may be refused entry, and no refund is owed in that case.


3. Your account

Some features (including buying tickets for paid events) require an account.
When you create one, you agree to:

  • Provide accurate, current information (including a valid email address and your
    name) and keep it up to date;
  • Keep your login credentials confidential and not share your account; and
  • Be responsible for activity that happens under your account.

You may sign in with a password, with a Google or Microsoft account, or with a
passkey (a device-based credential such as Touch ID, Windows Hello, or a
hardware security key), where we offer those options. How we handle the personal
information associated with your account is described in our
Privacy Policy.

We may suspend or close an account that we reasonably believe is being used for
fraud, abuse, ticket scalping, circumvention of our purchase limits, or any
breach of these Terms. You may ask us to close your account at any time, though
we may need to retain certain records (such as financial records) as required by
law.


4. Tickets and orders

A ticket is a limited, revocable licence to attend a specific event on the
date, at the venue, and under the conditions shown when you bought it. It is not
a property interest, and it remains subject to these Terms, the event's rules,
and our Code of Conduct.

Your ticket carries a name. Each ticket has a unique QR code and shows the
name entered for it at checkout. Admission is by QR code, and we may ask for
valid government-issued photo ID to confirm the event's minimum age. We may also
check that the name on a ticket matches the ID of the person presenting it, to
deter fraud and unauthorised resale. Where we plan to do this as a matter of
course at an event, we will say so on that event's page before tickets go on
sale. Keep your QR code private, and please make sure each ticket is in the name
of the person who will use it.

Each ticket admits one person once. Once a ticket has been scanned and
admitted at the door, it cannot be used again; a second scan will be refused and
will show when the ticket was first admitted.

Changing the name on a ticket. We don't offer self-serve transfers, but if
you need the name on a ticket corrected or changed -- including so that it
matches your ID -- email info@faunaesthetic.ca at least 48 hours before the
event. We'll change it once, free of charge, and send you an updated ticket.

Buying tickets for other people. At checkout, you can buy tickets for other
people by entering a name (and, optionally, an email address) for each ticket.
If you provide an email address for a ticket holder, that person receives their
own ticket and QR code by email. If you do this, you confirm that:

  • you have that person's permission to provide their name and email to us for
    this purpose; and
  • you are responsible for the accuracy of the details you enter, as we deliver
    tickets based on what you provide.

Beyond the name change described above, we don't reassign tickets between people
after purchase, and we do not authorise the resale of tickets. Because we may
check the name on a ticket against the ID of the person presenting it, a ticket
sold to someone else may not admit them, and no refund is due in that case.

Order confirmation. When you complete a purchase, you are entering an
agreement with us. We will send a confirmation, your ticket(s), and a receipt or
invoice to the email address on your order. Please keep these for your records.

Availability and limits. Tickets are sold subject to availability. We apply
reasonable per-order and per-customer purchase limits to keep sales fair and to
deter abuse; orders that exceed those limits, or that we reasonably believe to be
fraudulent or automated, may be cancelled.


5. Pricing, taxes, and payment

All prices are shown and charged in Canadian dollars (CAD). Before you pay,
we show the price of each item together with an itemized breakdown of any
applicable fees, service charges, and taxes, so the total you will be charged is
clear.

Taxes. Applicable taxes, including Ontario Harmonized Sales Tax (HST), are
calculated and shown at checkout and itemized on your receipt or invoice.

Payment processing. Card payments are processed by Stripe, our
third-party payment processor. Your card details are entered directly with
Stripe through its secure checkout; we never receive, see, or store your full
card number, security code, or expiry date.
Your use of Stripe's checkout is
also subject to Stripe's own terms and privacy policy.

Coupons and discounts. Where we offer a coupon or discount code, it is
generally single-use and may be limited to a particular event or time period,
and subject to any other conditions stated when it is issued. Discounts apply as
described at checkout and cannot be exchanged for cash.

Free events. Some events or tickets may be offered at no charge. Free
tickets are still subject to these Terms and to the applicable event rules and
age requirements.


6. Refunds and cancellations

All ticket sales are final, and tickets are non-refundable. Once your order
is paid, your ticket cannot be returned for a refund. Please make sure you can
attend before you check out.

If we cancel an event. If we cancel an event outright, we will refund the full amount you paid for your ticket, including fees and taxes, to the original payment method. We will email affected ticket holders and process refunds within 30 days of the cancellation.

If we postpone or reschedule an event. Your ticket will be valid for the new date. If you cannot attend the new date, email us at info@faunaesthetic.ca within 14 days of the rescheduling announcement and we will refund the full amount you paid.

If a venue or circumstances beyond our control prevent an event from going ahead, including fire, flood, severe weather, power failure, labour disruption, public-health order, or government direction, we will either reschedule the event or cancel it, and the refund terms above apply.

We do not issue automatic refunds. For full details and to ask about a specific
order, see our Refund Policy or contact us using the details in
Section 16.

Nothing in this section limits any refund or remedy you are entitled to under
applicable law that cannot be waived — see
Section 12.


7. Entry, conduct, and admission

Attending our events is a privilege extended on the conditions in these Terms,
the Code of Conduct, and any rules posted for the event or
venue. By attending, you agree to:

  • Present a valid ticket (QR code) for admission;
  • Provide valid government-issued photo ID on request, which we use to confirm
    the event's minimum age and may also check against the name on your ticket;
    and
  • Follow the reasonable instructions of our staff, security, and venue
    personnel.

We and the venue may refuse entry to, or remove, anyone who is underage for the
event, intoxicated, behaving unsafely or disrespectfully, harassing others, or
otherwise breaching these Terms or the Code of Conduct without a refund. We
may also refuse entry to anyone previously removed from one of our events or
banned under the Code of Conduct, whatever name a ticket is in.

Photography and recording. Our events may be photographed or recorded for
promotional purposes. By attending, you understand that you may appear in such
material. If you have concerns, please speak with our staff at the event.


8. Vendors and performers

If you apply to vend (for example, to rent a table) or to perform (for example,
as a DJ) at one of our events, additional terms apply. The detailed terms of
that relationship, including fees, obligations, liability, insurance, and
payment, are set out in the separate contract you sign for that engagement
(for example, through our contract-signing process). Those contracts govern your
vendor or performer arrangement in addition to these Terms, and where there is a
conflict for that arrangement, the signed contract prevails.

The application and booking features on the Site are offered subject to our
review and approval; submitting an application does not guarantee a spot or a
booking.


9. Acceptable use

When using the Site, you agree not to:

  • Use it for any unlawful, fraudulent, or harmful purpose;
  • Buy tickets other than for genuine personal or guest use. In particular, you
    may not acquire tickets for unauthorized commercial resale or scalping, or use
    bots or other automated means to buy tickets or evade purchase limits;
  • Attempt to access, enumerate, scrape, probe, or interfere with parts of the
    Site, other users' accounts, tickets, or data that you are not authorized to
    access;
  • Disrupt or overload the Site, or attempt to bypass its security or rate
    limits; or
  • Copy, resell, or commercially exploit the Site or its content except as we
    expressly permit.

In response to a breach of this section, we may take appropriate action,
including: cancelling orders, suspending or closing accounts, refusing
entry, and reporting to authorities.


10. Intellectual property

The Site and its content (including text, graphics, logos, branding, layout,
and software) are owned by or licensed to Faunaesthetic Events Ltd. and are
protected by intellectual-property laws. We grant you a limited, personal,
non-exclusive, non-transferable licence to use the Site for its intended purpose
of learning about and buying tickets to our events. You may not reproduce,
distribute, modify, or create derivative works from our content without our
permission, except as the law allows.

Content you submit to us (for example, details you enter when ordering or
applying) remains yours, but you grant us the permission we need to use it to
operate the Site and provide our services, as described in our
Privacy Policy.


11. Privacy and communications

How we collect, use, and protect your personal information is described in our
Privacy Policy. By using the Site, you acknowledge that policy.

We send two kinds of email:

  • Transactional emails: such as order confirmations, your tickets, password
    resets, refund notices, and event reminders. These are necessary to provide
    the service you asked for and are sent regardless of your marketing
    preferences.
  • Commercial (marketing) emails: such as announcements about upcoming
    events. We send these only if you have expressly opted in, in line with
    Canada's Anti-Spam Legislation (CASL). Every marketing email includes our
    identity, a mailing address, and a one-click unsubscribe link, and you can
    withdraw consent at any time.

12. Disclaimers and limitation of liability

Live events carry inherent risks. By attending an event, you accept the
ordinary risks of attending a live event (such as crowds, loud sound, and
physical activity) and agree to act responsibly for your own safety and that of
others.

The Site and our services are provided on an "as is" and "as available"
basis. To the fullest extent permitted by law, we disclaim implied warranties
and do not guarantee that the Site will be uninterrupted or error-free, or that
any particular event will take place as scheduled.

To the fullest extent permitted by law, our total liability to you arising
out of or relating to the Site, your tickets, or an event is limited to the
amount you actually paid to us for the order or ticket giving rise to the
claim.
We are not liable for indirect, incidental, special, consequential, or
punitive damages, or for lost profits, lost data, or losses we could not
reasonably have foreseen.

Consumer-rights carve-out. Nothing in these Terms excludes, restricts, or
modifies any right, warranty, guarantee, or remedy that you have under Ontario's
Consumer Protection Act, 2002 (or the Consumer Protection Act, 2023 once
it is proclaimed in force in its place) or other applicable Canadian law that
cannot lawfully be excluded or limited. Where such a right applies, these Terms
are read subject to it, and the limitations above apply only to the extent the
law permits.


13. Indemnification

You agree to indemnify and hold harmless Faunaesthetic Events Ltd. and its
directors, officers, employees, and agents from reasonable claims, losses, and
expenses arising out of your breach of these Terms, your misuse of the Site, or
your violation of any law or of the rights of another person, to the extent
those claims are caused by your acts or omissions. This does not require you to
cover losses to the extent they are caused by our own negligence or breach.


14. Changes to these Terms

We may revise these Terms from time to time. The current version is always
posted on the Site with its effective date. Material changes will be brought to
your attention by reasonable means. Your continued use of the Site after an
updated version is posted constitutes acceptance of the revised Terms.


15. Governing law and disputes

These Terms, and any dispute arising out of or relating to them, the Site, or
your tickets, are governed by the laws of the Province of Ontario and the
federal laws of Canada applicable there, without regard to conflict-of-laws
rules. You agree that the courts of the Province of Ontario have exclusive
jurisdiction, except where applicable consumer-protection law gives you the
right to bring proceedings elsewhere or before a tribunal.

If any provision of these Terms is found to be unenforceable, the remaining
provisions remain in full effect.
